Buying a house or flat is a big step that involves a lot of bureaucracy – especially if you don’t speak (sufficient) German. An interpreter, ideally a sworn interpreter, is then required to be present during the notary appointment.
Sworn Interpreter
In order to become a sworn interpreter, certain requirements must be met. The interpreter must submit an application to the court, in my case the Regional Court of Heidelberg, and enclose proof of professional training. An M.A. in conference interpreting or comparable training is required. If the evidence cannot be provided, the applicant must take an examination in Karlsruhe in order to subsequently prove their interpreting skills. Only after passing this examination is the applicant then authorised to interpret for notaries as a sworn interpreter. I myself have been a sworn liaison interpreter for the English language for the courts of the state of Baden-Württemberg since 2019.
Notary Appointments
An interpreter must not only be present when the purchase contract for a property is read out, but also during other notary appointments, if one of the parties speaks little German. Examples of this are appointments for a marriage contract, a divorce agreement or the creation of a land charge, which is often closely linked to property purchase. Especially for such appointments, it makes sense to use an interpreter who is already familiar with the subject, as there is a high density of legal terms and concepts that need to be well prepared.
